It is possible that you might mistakenly assume responsibility without considering all the circumstances surrounding the accident. We encourage you to provide us with the details so that a representative from “it happens” can provide a professional assessment of your case and offer recommendations for the next steps.

If your personal belongings were damaged as a result of the accident and you had to bear the costs of repair or replacement, or if you incurred expenses using personal funds during the course of the case such as travel expenses, medical treatment, medication costs, car rental, postage, or telephone expenses, these losses will be reimbursed by the party at fault. However, reimbursement will be granted only if the expenses are justified, and you have the necessary invoices/receipts as evidence.

In cases involving severe injuries like limb fractures or head/brain injuries, where the duration of the claim statistically exceeds 12 months, you have the option to apply for an interim payment. The remaining compensation, taking into account the interim payment, will be paid to you upon the conclusion of the case. It’s important to note that this is only possible if the party at fault has fully admitted responsibility for the incident.

Indeed, it is possible to seek compensation in such circumstances. It is understandable that you may have reservations due to the moral aspect of filing a claim against a family member. However, it is essential to recognise that the claim is directed towards the insurance company of the responsible party, rather than the individual themselves.

The company’s payment for services rendered is due at the conclusion of the process. The payment is capped at 25% of the total compensation amount received. It’s important to note that compensation for future losses, such as earnings and care costs, is not subject to withholding. As per the changes in law implemented on 31st May 2021, participants in road traffic accidents involving 4-wheeled vehicles may be liable to pay 40% service fees if their settlement amount is below £5,000.00.

It’s crucial to mention that this particular rule does not apply to pedestrians, motorcyclists, cyclists, or users of personal moving devices such as scooters. For these individuals, the payment structure remains capped at 25% of the total compensation amount received.

If the settlement amount exceeds £5,000.00, participants in road traffic accidents involving 4-wheeled vehicles will still pay only 25% for the services.

Certainly, you are eligible for compensation as the accident occurred within the three-year timeframe. To successfully obtain compensation, the key criteria would be either ongoing symptoms related to the accident or a documented history of treatment and visits to healthcare professionals such as doctors or rehabilitation therapists following the incident. These factors will play a significant role in supporting your claim for compensation.
